Halaabja Governor Blocks the AVA Media Team

Today, Friday, October 30, 2026, at around 2:00 PM, during the activities of the Pomegranate Festival in Halabja, Nukhsah Nasih, the Governor of Halabja, obstructed the press team of “AVA Media” and denied them permission to conduct live coverage and journalism for the festival’s events.

In a statement to the Kurdish Intellectuals Organization in the UK, Aras Rafiq, AVA Media’s correspondent in Halabja, stated: “The main reason for this obstruction stems from the Halabja Governor’s anger toward AVA Media. This came after AVA Media responded to requests from a number of citizens and festival participants asking the outlet to cover the event to help market and promote their produce. Once AVA Media expressed its readiness to participate and cover the event, this stance caused concern and anger from the Governor, ultimately resulting in the team being barred.”

This restriction comes at a time when Kurdistan Region laws fully guarantee the rights of media organizations to cover public events.

Kurdistan Region Press Law (No. 35 of 2007):

• Article 2 / Paragraph 1: Emphasizes that journalists are free to collect and publish news and information, and official institutions and provincial administrations are obligated to facilitate and provide information to journalists.

• Article 5: Indicates that obstructing a journalist or confiscating media equipment without a court order is a clear violation of press freedom and constitutes an unlawful exercise of authority.

Right to Information Law (No. 11 of 2013):

This law also explicitly reaffirms that every citizen and media outlet has the right to access information during public activities and festivals, and government institutions cannot restrict the dissemination of information or authorized media coverage.

Violating these rights, beyond being a blatant breach of the Kurdistan Region’s Press Law, harms the climate of press freedom and undermines support for small business owners and participants in public events.

ئەمڕۆ هەینی، ٣٠ی تشرینی یەکەمی ٢٠٢٦، نزیک کاتژمێر ٢:٠٠ی دوای نیوەڕۆ، لە میانی بەڕێوەچوونی چالاکییەکانی ڤێستیڤاڵی هەنار لە هەڵەبجە، نوخشە ناسیح، پارێزگاری هەڵەبجە، ڕێگری لە تیمی ڕاگەیاندنی “ئاڤا میدیا” کردووە و ڕێگەی پێنەداون رووماڵی ڕاستەوخۆ و ڕۆژنامەوانی بۆ چالاکییەکانی ڤێستیڤاڵەکە بکەن.

لەلێدوانێکدا بۆ ڕێکخراوی ڕۆشنبیرانی کورد لە بەریتانیا، ئاراس ڕەفیق، پەیامنێری ئاڤا میدیا لە هەڵەبجە ڕایگەیاند: هۆکاری سەرەکیی ئەم ڕێگرییە دەگەڕێتەوە بۆ تووڕەیی پارێزگاری هەڵەبجە لە ئاڤا میدیا. ئەوەش دوای ئەوەی ئاڤا میدیا وەڵامی داواکاریی ژمارەیەک لە هاووڵاتیان و بەشداربووانی ڤێستیڤاڵەکەی دابووەوە، کە داوایان کردبوو ئاڤا میدیا ئامادەیی هەبێت بۆ رووماڵکردن تاوەکو یارمەتیدەر بێت لە بەبازاڕکردن و پرفرۆشکردنی بەرهەمەکانیان. دوای ئەوەی ئاڤا میدیا ئامادەیی خۆی بۆ بەشداری و رووماڵ دەربڕی، ئەم هەڵوێستە بووە هۆی نیگەرانی و تووڕەیی پارێزگار و لە ئەنجامدا ڕێگری لە تیمەکە کرا.

ئەم ڕێگرییە لە کاتێکدایە کە یاساکانی هەرێمی کوردستان مافی تەواویان داوە بە دەزگاكانی ڕاگەیاندن بۆ ڕووماڵکردنی چالاکییە گشتییەکان.

یاسای ڕۆژنامەگەری لە هەرێمی کوردستان (ژمارە ٣٥ی ساڵی ٢٠٠٧):

ماددەی دووەم / بڕگەی یەکەم: جەخت لەسەر ئەوە دەکاتەوە کە ڕۆژنامەنوس ئازادە لە کۆکردنەوەی زانیاری و هەواڵەکان و بڵاوکردنەوەیان، هەروەها دەزگا فەرمییەکان و ئیدارەی پارێزگاکان پابەندکراون بە ئاسانکاری و دابینکردنی زانیاری بۆ ڕۆژنامەنوسان.

ماددەی پێنجەم: ئاماژە بەوە دەکات کە ڕێگری کردن لە ڕۆژنامەنوس یان دەستبەسەرداگرتنی کەلوپەلی ڕاگەیاندن بەبێ بڕیاری دادگا، پێشێلکارییەکی ئاشکرای ئازادیی ڕۆژنامەگەرییە و بەکارپێکردنی دەسەڵاتە بەدەر لە یاسا.

یاسای مافی دەستکەوتنی زانیاری (ژمارە ١١ی ساڵی ٢٠١٣):

ئەم یاسایەش بەڕوونی جەخت دەکاتەوە کە هەموو هاووڵاتییەک و دەزگایەکی ڕاگەیاندن مافی دەستکەوتنی زانیارییان هەیە لە چالاکییە گشتییەکان و میهرەجانەکاندا، و دامودەزگا حکومییەکان بۆیان نییە ڕێگری لە گەیاندنی زانیاری و رووماڵی میدیایی بڕیار لێدراو بکەن.

پێشێلکردنی ئەم مافانە، جگه لەوەی پێشێلکارییەکی ئاشکرای یاسای ڕۆژنامەگەریی هەرێمی کوردستانە، زیان بە کەشوهەوای ئازادیی ڕاگەیاندن و کارئاسانی بۆ کاسبکاران و بەشداربووانی ڕووداوە جەماوەرییەکان دەگەیەنێت.
